County Clerk Tim Idoni has initiated a program to alert Westchester municipalities that a foreclosure proceeding has been commenced by a lending institution against a local property owner. Foreclosed properties are quite often abandoned or kept in disrepair during the process, harming the local neighborhood, or ignored by the bank or financial institution filing the foreclosure.

Idoni Honored as New York's County Clerk of the Year

County Clerk Wins Two State Awards

Westchester County Clerk Tim Idoni was honored by his peers with two prestigious awards on June 12, 2017 at the New York State Association of County Clerks (NYSACC) conference held in Lake Placid, New York. Idoni, currently serving in his twelfth year as the county’s recorder of land records and Clerk of the Supreme and County Courts, was hailed for his leadership in professional management processes, legislative advocacy and twenty-first century technological advancements. These are the ninth and tenth awards won since 2010, primarily for technological leadership and fiscal efficiency through systems that can be duplicated in counties all over the country.

Search Documents on Westchester Records Online

Search thousands of Westchester County Clerk records right from your home or office through our online portal, Westchester Records Online (WRO), by clicking the "Records Online" button on the left. You can find records ranging from 18th century deeds to judgments entered in our Legal Division last week to subdivision maps and atlases spanning the entire history of Westchester County. There is a fee to view images of documents (to offset the cost of scanning these documents), but quite a bit of data about a document is available free of charge. Click on "Records Online" and follow the instructions on the screen to get started. Sensitive documents such as matrimonial judgments or other sealed documents are not available online and require you to visit our office in White Plains and show proper identification. Documents submitted to our office for recording must have cover pages created using the Westchester County Clerk's Property Records Electronic Portal (PREP) System. In addition, New York State Department of Taxation and Finance Combined Real Estate Transfer Tax Returns (TP584s) and/or Real Property Transfer Reports (RP-5217s) must be created using this system.

Requirements for Affidavits Under Section 255

All maps filed in the Office of the Westchester County Clerk must meet the following requirements:

1. All maps must be clear, not crowded and reproducible;
2. All maps must be in black and white. No shading, no color;
3. All signatures must be in black permanent ink, not ballpoint pen;
4. All signatures and seals must be original;
5. No pencil or paste ups;
6. All maps must have a title and location;
7. All maps must have date map was drafted;
8. Each sheet must be no larger than 36” x 48” and no smaller than 8 ½” x 11”;
9. All maps must have tax designation reference - section block and lot or tax ID;
10. All maps must have the Westchester County sheet and block number. This can be found in the blue book or online at http://wro.WestchesterClerk.com on the maps tab, under resource maps tab, choose County Block Index Maps;
11. All maps must have a location map. This must clearly show site with surrounding streets; and
12. All maps must be on linen or mylar.

The County has the authority to reject maps that are not legible for scanning as per §333b of the Real Property Law.

For Subdivisions/Re-Subdivisions/Amended Subdivisions:

In addition to complying with the Requirements for All Maps set forth above, the subdivision map being submitted for filing must contain:

1. the original signature, original seal and certification of the surveyor;
2. the applicable Planning Board’s signature and date of approval which must be within 62 days of filing;
3. the original signature and certification of the Health Department, which must be within one year of filing;
4. the signature of the property owner;
5. the map must contain or be accompanied by an original signed and dated statement by the local Receiver of Taxes which indicates that all taxes on the property have been paid in full, which refers specifically to the property by section, block and lot, and which is dated after the date of the Planning Board signature and within 45 days of filing; and
6. the map must be accompanied by an original signed and dated title or abstract company letter which indicates that all taxes have been paid in full, which refers specifically to the property by section, block and lot, which is dated after the date of the Planning Board signature, but within 45 days.

For Floor Plans:

In addition to complying with the Requirements for All Maps, a floor plan being submitted for filing must contain:

1. the original signature, original seal and certification of the architect;
2. the original signature and certification of the local Tax Assessor; and
3. the original signature and certification of the sponsor or owner.

For Site (Location) Plans and Individual Surveys (this does not pertain to subdivisions of a condominium property):

In addition to complying with Requirements for All Maps, a site plan or individual survey being submitted for filing must contain:

1. the original signature, original seal and certification of the surveyor; and
2. the original signature and certification of the property owner.

For Easements:

In addition to complying with Requirements for All Maps, a site plan or individual survey being submitted for filing must contain:

1. the original signature, original seal and certification of the surveyor; and
2. the original signature of the property owner.

Condemned Property Acquisition Map:

In addition to complying with Requirements for All Maps, a condemned property acquisition map must be for one parcel only and must contain:

1. the original signature, original seal and certification of the surveyor; and
2. the original signature of the property owner.

To locate a map, visit the Land Records Division of the Office of the Westchester County Clerk which is located at 110 Dr. Martin Luther King Jr. Blvd. in White Plains between the hours of 8 a.m. and 5 p.m., Monday through Friday, excluding legal holidays.  You may also wish to review maps other than subdivision maps on file with the Westchester County Planning Department or the Westchester County Archives.

NYS Transfer Tax

For the most current tax information please visit the NYS Department of Taxation and Finance website. If the consideration for the property is greater than $500.00, New York State Transfer Tax in the amount of $2.00 for each $500.00 of consideration or fraction thereof is due. Consideration must be rounded up to the nearest $500.00. For example, if the purchase price for a home is $404,501.00, the tax due is $1,620.00 and must be paid at the time the deed is presented for recording. NYS Mansion Tax

Mansion Tax is imposed on each conveyance of residential real property when the consideration for the entire conveyance is one million dollars or more and the premises is being used in whole or in part as a one, two or three family house, or a condomimium.  The tax rate is one percent of the consideration.

NYS Mortgage TAX (effective June 1, 2005)

For the most current tax information please visit the NYS Department of Taxation and Finance website. Mortgage tax can be computed by calculating 1.3% of the mortgage amount less $30.00 for one or two family dwellings when indicated in the mortgage. For Yonkers properties, mortgage tax can be computed by calculating 1.8% of the mortgage amount less $30.00 for one or two family dwellings when indicated in the mortgage. For mortgages of $10,000 or less on one or two family dwellings, the tax rate is 1% except in Yonkers where the tax rate is 1.5%. In calculating the tax, amounts of $50.00 or below can be rounded down to the lower hundred and amounts of $50.01 should be rounded up to the next hundred. Surveys are not usually filed in the Office of the Westchester County Clerk. While it is possible that a survey could have been recorded in our office, we recommend that you begin your search by checking with the local building department in the municipality in which the property is located.
