County Clerk Tim Idoni has initiated a program to alert Westchester municipalities that a foreclosure proceeding has been commenced by a lending institution against a local property owner. Foreclosed properties are quite often abandoned or kept in disrepair during the process, harming the local neighborhood, or ignored by the bank or financial institution filing the foreclosure.

If you are a Westchester County resident and are in need of a personal identification card, you may apply in person at the Westchester County Clerk’s Licensing Office, 110 Dr. Martin Luther King Jr. Boulevard, Room 340 in White Plains, New York. The office is open to the public from 8:00 a.m. – 4:30 p.m., Monday through Fridays excluding holidays.

Idoni Honored as New York's County Clerk of the Year

County Clerk Wins Two State Awards

Westchester County Clerk Tim Idoni was honored by his peers with two prestigious awards on June 12, 2017 at the New York State Association of County Clerks (NYSACC) conference held in Lake Placid, New York. Idoni, currently serving in his twelfth year as the county’s recorder of land records and Clerk of the Supreme and County Courts, was hailed for his leadership in professional management processes, legislative advocacy and twenty-first century technological advancements. These are the ninth and tenth awards won since 2010, primarily for technological leadership and fiscal efficiency through systems that can be duplicated in counties all over the country.

Search Documents on Westchester Records Online

Search thousands of Westchester County Clerk records right from your home or office through our online portal, Westchester Records Online (WRO), by clicking the "Records Online" button on the left. You can find records ranging from 18th century deeds to judgments entered in our Legal Division last week to subdivision maps and atlases spanning the entire history of Westchester County. There is a fee to view images of documents (to offset the cost of scanning these documents), but quite a bit of data about a document is available free of charge. Click on "Records Online" and follow the instructions on the screen to get started. Sensitive documents such as matrimonial judgments or other sealed documents are not available online and require you to visit our office in White Plains and show proper identification. Satisfactions of Mortgage should be recorded in the Office of the County Clerk of the county in which the mortgage has been recorded.  When recording a Satisfaction/Discharge/ Release of Mortgage, it is the responsibility of the last holder of the mortgage on record to execute a Satisfaction/Discharge/Release of Mortgage document and to ensure that the document meets all of the legal requirements for recording.

Recording a Satisfaction:

In order to record a Satisfaction in the Office of the Westchester County Clerk, the satisfaction must be accompanied by:

1) A Recording and Endorsement Cover Page created on the PREP System; and
2) A Payment Cover Page created on the PREP System and the proper recording fees.

Fees:

The fee to record a one page Satisfaction/Discharge/Release of Mortgage with no assignments, is $50.50.  If your Satisfaction/Discharge/Release of Mortgage is more than one page or references assignments, please calculate the filing fee as follows:

Statutory charge: $45.00
Each written side of page: $5.00 per page
Cross reference to mortgage being satisfied: $0.50 each
For each agreement connected to the mortgage(s) being satisfied: $0.50 each
For each mortgage after the first being satisfied by this instrument: $50.50 each
Per mortgage recited within the agreements connected to the mortgage(s) being satisfied: $0.50 each

Note that each mortgage (recited in satisfaction instrument) affected by any one of the above cross reference-type instruments constitutes one cross reference e.g., if three (3) mortgages (recited in satisfaction instrument) have been assigned by one instrument, then three (3) cross references will be charged for.

Returning your Satisfaction of Mortgage:

Once the Satisfaction has been accepted for recording, it is digitally scanned for easy retrieval and to safeguard the document.  After scanning and digitally archiving the satisfaction, the original will be returned to the address that appears in the Record and Return Box on the cover page.

Mortgages should be recorded in the Office of the County Clerk of the county in which the real property being mortgaged is located. When recording a mortgage, it is your lender's responsibility to take the proper steps to ensure that the document meets all of the legal requirements for recording. Please be sure to consult an attorney if necessary.

Submitting your mortgage to be recorded using PREP:

In order to record a mortgage in the Office of the Westchester County Clerk, your mortgage must be accompanied by:

1) A Recording and Endorsement Cover Page created on the PREP System; and
2) A Payment Cover Page created on the PREP System and the proper recording fees and tax payments.

Mortgage Tax:

For the most current tax information please visit the NYS Department of Taxation and Finance website. Mortgage tax can be computed by calculating 1.3% of the mortgage amount less $30.00 for one or two family dwellings when indicated in the mortgage. For Yonkers properties, mortgage tax can be computed by calculating 1.8% of the mortgage amount less $30.00 for one or two family dwellings when indicated in the mortgage. For mortgages of $10,000 or less on one or two family dwellings, the tax rate is 1% except in Yonkers where the tax rate is 1.5%. In calculating the tax, amounts of $50.00 or below can be rounded down to the lower hundred and amounts of $50.01 should be rounded up to the next hundred.

Deeds should be recorded in the Office of the County Clerk of the county in which the real property being transferred is located. When recording a deed, it is your responsibility to take the proper steps to ensure that the document meets all of the legal requirements for recording. Please be sure to consult an attorney if necessary.

Submitting Your Deed to be Recorded Using PREP:

In order for a deed to be accepted for recording in the Office of the Westchester County Clerk, a deed must be accompanied by the following properly completed forms:

1) A Recording and Endorsement Cover Page created on the PREP System;
2) A New York State Department of Taxation and Finance Form TP-584 which must be created in the PREP System;
3) A Real Property Transfer Report, Form RP-5217 which must be created in the PREP System; and
4) A Payment Cover Page created on the PREP System and the proper recording fees and tax payments.

New York State Transfer Tax:

For the most current tax information please visit the NYS Department of Taxation and Finance website. If the consideration for the property is greater than $500.00, New York State Transfer Tax in the amount of $2.00 for each $500.00 of consideration or fraction thereof is due. Consideration must be rounded up to the nearest $500.00. For example, if the purchase price for a home is $404,501.00 you must round the purchase price up to $405,000.00 to calculate the transfer tax. The tax due is $1,620.00 and must be paid at the time the deed is presented for recording.

NYS Mansion Tax:

Mansion Tax is imposed on each conveyance of residential real property when the consideration for the entire conveyance is one million dollars or more and the premises is being used in whole or in part as a one, two or three family house, or a condominium. The tax rate is one percent of the consideration.

Returning Your Deed:

Once the deed has been accepted for recording, it is digitally scanned for easy retrieval and to safeguard the document.  After scanning and digitally archiving the deed, the original will be returned to the address that appears in the Record and Return Box on the cover page. If you will need a certified copy of your deed quickly, you should order a certified copy, using a separate check for the certified copy, at the time the document is submitted for recording.

Changing Your Deed:  

We are a recording office and are able to offer assistance with questions regarding recording requirements and the recording process.  However, we are not able to offer advice on how to prepare the papers that are offered to our office for recording, such as a deed.  If you need assistance in preparing a deed, you will need to contact an attorney.  And once you have prepared your document, we would be happy to assist you with recording it in our office.

The Office of the Westchester County Clerk returns original documents once they have been recorded, scanned and digitally archived by our office. If you cannot locate your original document, our office can provide you with a certified copy which has the same validity as your original document.

To obtain a certified copy of a land record such as your deed, visit the Land Records Division of the Office of the Westchester County Clerk which is located at 110 Dr. Martin Luther King Jr. Blvd. in White Plains between the hours of 8:00 a.m. and 5 p.m., Monday through Friday, excluding legal holidays.  To obtain a certified copy of your land record by mail, please send a letter which contains as much of the following information as possible:

  • the name of the document you are searching for such as "a deed"; and
  • the name of the owner, the property address including the village, town or city; and
  • the approximate date of the transaction; and
  • the liber and page number or the control number, if known. 

Please include a check payable to "Westchester County Clerk" in the amount of $5.00 for documents up to four pages plus $1.25 for each additional page.  Cash is not accepted and all fees must be included with your written request. Please mail your request to:
