How can I obtain a copy of my divorce decree?
In order to obtain a copy of a divorce decree, you may come in person to the Office of the Westchester County Clerk, Legal Division with proper identification such as a valid driver's license or passport. You must be a party to the action or the attorney of record in order to access a divorce file. If you are not a party or the attorney of record, you must obtain a notarized release from one of the parties to the action. The fee for a certified copy of the divorce decree is $1.25 per page with a minimum fee of $5.00, and a maximum fee of $40.00. This can be paid in cash, by check or money order, or by American Express, Discover, MasterCard or Visa. If you wish to mail your request, please enclose a check payable to the "Westchester County Clerk" and indicate “Not to exceed $40.00” under the line that you leave blank for the amount in words. If you do not know the Index Number of the case, there will be an additional $5.00 fee incorporated for the search, and therefore the check should be "Not to exceed $45.00." We do not accept cash or credit card payments by mail. Your request should be in the form of a letter which has your signature notarized and includes the names of both parties and the approximate date of divorce. Please include a self-addressed, stamped envelope with your request. Our office will mail the documents that you requested as well as a receipt for the certification and copying charge.
